The court found that the buyer had not proved that other requirements that those indicated in a facsimile existed. As the approval of the country of import (Kuwait) had not been made part of the agreement the buyer were not entitled to avoid the contract. The buyer did not lift its burden of proof that an agreement to cancel the contract had been made with the seller.
