Abstract

The initial dispute concerned formation of contract. The Italian seller had shipped the goods, but the Bulgarian buyer had not paid, arguing that a contract had not been formed under domestic Bulgarian law. At the appeals case the court stated that a written contract was not required and that the existence of a contract could be proved by use of witnesses. Consequently, the buyer was required to pay.
